1.Definitions and interpretation
In these Terms the following words have the following meanings.
“we”, “us” and “our” mean Debbie Clifford Ltd, trading as Bo & Co Bridal, as described in the preamble above.
“you” and “the Customer” mean the person who books an Appointment with us or who buys a Dress from us.
“Dress” means any dress, gown or other item of bridal wear that we offer for sale to you.
“Sample” means a designer Dress held in the boutique that has been used for fittings and is offered for sale as seen.
“Appointment” means a private fitting booked with us at the boutique.
“Out of Hours Appointment” means an Appointment that takes place outside our normal working hours, as set out in clause 3.
“Booking Fee” means the charge payable for an Out of Hours Appointment, as set out in clause 3.
Clause headings are for ease of reference only and do not affect the meaning of these Terms. A reference to one gender includes all genders, and the singular includes the plural and the other way round.
2.About us and these Terms
We are Debbie Clifford Ltd, a company registered in England and Wales, trading as Bo & Co Bridal. Our registered office and boutique are at 3 Cuckfield House, Wellington Road, Wanstead, London E11 2AN.
You can contact us by email at hello@boandcobridal.co.uk.
These Terms apply to your Appointment and to any purchase of a Dress from us. By booking an Appointment or buying a Dress you confirm that you accept these Terms.
We may amend these Terms from time to time. The version that applies to your purchase is the version in force on the day you buy your Dress.
3.Appointments
We are a by-appointment boutique. We see one party at a time so that the room is yours alone for the duration of your Appointment.
A standard Appointment is a free, private fitting of two hours. There is no charge for an Appointment within our normal working hours.
To book, please choose a time through the website or contact us and we will arrange a time with you. If your plans change, please let us know as early as you can and we will do our best to move your Appointment.
An Out of Hours Appointment may be available on request and carries a Booking Fee of £25, payable when you book.
If you buy a Dress from us, the Booking Fee is redeemable in full against the price of your Dress.
You may reschedule an Out of Hours Appointment once, provided you give us at least 48 hours’ notice before the Appointment. If you cancel an Out of Hours Appointment outright, or give less than 48 hours’ notice, the Booking Fee is not refundable.
4.The Dresses
Every Dress in the boutique is a high end designer Sample, sold as seen. Each Sample has been used for fittings and cared for accordingly.
Where a Dress has any small mark, repair or sign of wear, we will point this out to you before you decide to buy, so that you know the condition of the Dress you are buying.
The Dress you try on is the Dress you buy. We sell the actual Sample on the day, not a new or unworn version of it.
5.No reservations
We do not hold or reserve Dresses. We cannot set a Dress aside while you decide.
A Dress is secured only once you have paid for it in line with clause 6. Until then, the Dress remains available for any other Customer to buy.
6.Price and payment
The price of each Dress is the price marked in the boutique. We will confirm the full price with you before you commit to buy.
The price of your Dress is payable in full on the day you choose it.
The Dress remains our property until you have paid the price in full, at which point ownership of the Dress passes to you.
7.Collection
Your Dress goes home with you once you have paid the price in full, or at another time that we agree with you.
Until the Dress is collected, we will keep it safe for you at the boutique.
8.Refunds and exchanges
Every dress we sell is a one off designer sample, sold as seen and inspected by you before purchase. For this reason all sales are final, and we do not offer refunds or exchanges.
Nothing in these terms affects your legal rights as a consumer.
9.Alterations
Alterations are not included in the price of a Dress.
You are responsible for arranging any alterations with a seamstress of your choice. We are happy to suggest a seamstress we trust if that would help you.
10.Made to order
Where we offer a made to order Dress, separate terms and timescales apply to that order.
We will set out those terms and timescales with you before you place a made to order Dress, and they will apply in addition to these Terms.
11.Our liability
We are not liable for alteration work, or for any other work, carried out by a seamstress or any other third party. Such work is a matter between you and the third party concerned.
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so. This includes our liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation.
Subject to clauses 8.2 and 11.2, we are not liable for any loss or damage that was not foreseeable at the time these Terms were made.
12.Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them are governed by the law of England and Wales.
The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
